After elections: Sludge hits the fan

Liberty Energy will continue moving forward with its proposed “sludge” plant in the Northend of Imperial County despite the apparent passage of a measure prohibiting the importation of biowaste.

Moments after unofficial final results were posted early Wednesday showing that Measure X, which prohibits the importation of sewage sludge into Imperial County, was passed, Liberty Energy’s Luis Plancarte said the project would continue.

“Our focus has always been on the (environmental impact report),” Plancarte said. “We’ll continue to focus on that and continue to get all the information to provide the community and the project a complete review of the EIR.”

The project, proposed by Bakersfield-based Liberty Energy, would see the importation of biowaste and biosolids, known as “sludge,” imported from Southern California counties into Imperial County. Once at the proposed project site north of Niland, the sludge would be turned into renewable energy.

Tuesday’s results show 8,684 people, or 67.8 percent, voted for Measure X, while 4,110 people, or 32.1 percent, voted against it.

“We’re really, really excited,” Monique Lopez, who represents Imperial Valley Residents for Health and Safety First, said. “I’d like to thank the voters that participated in the process and who played a very critical part in the decision-making of this county.

“People here in the Valley take pride in their community,” Lopez said. “This just further confirms that the community doesn’t want sludge dumping upon them.”

Despite the loss at the polls, Plancarte said it was important to focus on the EIR.

“We’ve always maintained that the EIR is the process by which projects like this are evaluated,” he said. “We will continue on that path. We will continue with the EIR process.”

Liberty Energy chief executive officer Wilson Nolan did not return calls seeking comment for this story.

Last month Imperial County Counsel Ralph Cordova said he had heard a rumor that if Measure X passed it could be challenged in court.

On Wednesday, Cordova maintained his original sentiment, but said he has not heard any recent talk about a possible challenge.

“Generally speaking, any ordinance can be challenged,” Cordova said, “however, I haven’t heard anything, rumor or otherwise, that there is going to be a challenge since the last time I heard the rumor there was going to be.”

Cordova did not disclose where he heard the rumor.

When asked about whether Liberty would challenge the measure, Plancarte said he did not know enough about the legal process to comment on possible legal action.

Lopez said her group would continue to follow the Liberty project closely.

“We will be participating in the EIR process and getting our community to look closely at that as well,” she said. “We stand by our decision to protect the health and safety of our community and we will be following these projects closely.”

" Unfortunately, pollution is a "commodity" that's traded, sold, and bought. In order to to make money off of emission credits or carbon offsets, you must become a polluting source. So there are govt. incentives to create pollution. Solar won't take off until the govt. gives out corporate welfare checks to "help" it along. Hey why hasn't anybody captured the energy from California's ocean waves-hydroelectric? The coastal communities can use that energy to burn their sludge. No long transportation routes. No long lines at the border. Waves are renewable energy, right? Oh, I forgot, they don't pollute. "

I feel the reason it's taking so long for the EIR to be released is because Nolan and crew ARE, in fact, reading and listening to what our county's concerns are, and then they're "going back to the drawing board", so to speak, tweaking the facts and changing the wording (i.e. "bio-solids" and "bio-mass") in hopes of making the report sound more appealing to all concerned. So Nolan, aka "The Crap-Master", claims Liberty will truck their poop through our valley and on into Mexico if we turn them down? Is that supposed to be a threat? Gee, it seems to me that if you're heading to Mexico via L.A. or San Diego, the San Ysidro Port of Entry is a lot closer to your locale. Second: why not Measure was placed in the ballot for the proposed conversion of the Gold Mine into a garbage land field? How come no controversy? How come no activity to prevent the county to become a trash-depository? Too far from urban areas?
Stuff may fall & filter into the underground. This may be affect back to us somehow.
A Land Field is not productive as a Generation Plant, in revenue, in number of jobs created and in number of jobs preserved, long lasting.

" The election of a President is based on electoral delegates, not by direct majority, to ensure a representation of remote, less populated areas against a misleading majority of urban places. without this, most presidents would be elected by the wishes of the Coastal areas. Mid-continental areas (including Imperial County) wishes would not be included.
The MeasureX results are based on direct majority count. For the size of the County, a referendum based on "electoral delegates" WILL NOT be practical, but a 67%-Yes vs. 33%-No does not reflect the wish of the entire community. Non-participants in the voting process (voters leaving blank the option, absenteesm or Resident Aliens that cannot vote) are not counted for.
Too bad for them (all of the above mentioned)? YES, shamme or pitty. Still, does not reflect the wish of the majority.
MeasureX was placed on the ballot without the famous Environmental Impact Study Report.
If MeasureX was intended to prevent spills & spread of germs, infections and all that stuff some fear, we already have measures to prevent & repair such events: EPA, OSHA, Health Codes & Regulation from Fed, State and County.
MeasureX should been placed on ballot after the Impact Report. "
