Our Opinion: Sludge debate probably not over

Measure X, the local proposition aimed at stopping the importation of sludge into the county, was passed overwhelmingly by voters on Tuesday. But that doesn’t mean we have heard the last of this issue.

Liberty Energy, the company that wants to build a sludge-to-energy plant in Niland, has said it will continue the process of getting approvals for the plant, including the upcoming environmental impact report.

So despite the fact that nearly 68 percent of Imperial County residents who voted on the issue were against importing sludge into the county, the end is not in sight. And that is a good thing, because as we have said from the beginning of this process, the EIR is an important document and needs to be completed.

Why? Because facts seem to be rare in this debate. There are phrases tossed around about saving our children and saving agriculture, but those are red herrings. They are designed to fire people up and mobilize them, not to inform them.

The EIR will inform us all — including Liberty. Like everyone on both sides of this issue, we have no idea what the EIR will say. If it says the plant would be toxic for our air and generally bad for our environment, we will be the first in line to fight against it. We do not need any industry that is bad for Imperial County.

But what if the EIR shows that the technology is sound and the plant will have no adverse effects on the environment? What will we do if the negative impacts that people have been talking about for months are not fact but myth? Will it be too late to do anything about it?

That was our main complaint with this measure. We applaud local activism aimed at helping a community or a repressed segment of society. But this effort seems misguided in that it came before the EIR was even completed. This was simply a case of jumping the gun in a big way.

And remember, this will not stop the trucks loaded with sludge that already travel through our county every day.

Whether or not this measure will be challenged in court is an open question. It could be, of course, especially if an EIR that is favorable to the project is released. If that turns out to be the case, we hope that those people opposed to the plant put their emotions aside, accept the science and support the project.

If the report shows potential problems for our valley, we will lead the charge against the plant.

" I agree with bermudezfamily. I too reviewed the PMC EIR for the ethanol facility to be placed near Calipat and found the same thing to be true.

Also, we must look at not only local but global environmental consequences/adverse affects. About a year ago when I submitted my comments in regards to the environmental and health concerns of this proposed plant, I recall this newspaper insinuating that my comments and those similar to I were just scare tactics/ red herrings as well and against growth/economic development. Well, as my good friend says..."cancer is a growth too, but it is a growth we don't want for our body. The same is true with the body of our community. We want healthy economic growth."

I agree, the EIR is an important document to complete; however, the project description as stated on the Liberty Energy permit application is falsified. It states that it is a biomass power plant. However, that is far from the truth. First, the main thing that will be incinerated at the proposed plant is biosolids [which is very different than biomass]. Moreover, it is not a power plant it is an incinerator and therefore needs to jump through different “hoops” and an EIR will have to address a whole host of other issues. Liberty Energy was caught in the act of lying in Ontario, Canada.

“An Ontario government decision last month forced Liberty Energy to re-start the environmental assessment of the company’s proposed Strathearne Avenue incinerator, leading the company to issue a formal “notice of commencement” for the new environmental process last week, and bitterly note the Ontario government’s requirement that “the entire environmental screening process must be performed again”. In 2005, the provincial environment ministry had allowed the company to define its incinerator as an electricity project because Liberty expects up to 10 megawatts will be produced for sale to the Ontario grid. Such is the case with the Liberty XX proposal. Therefore, the EIR process needs to start all over again if it is to be done correctly and adequately scientifically review the TRUE nature of the project.

But what’s the big deal? Why would Liberty want to market it as a power plant/ renewable energy? Hmmm…let’s see…because there is great money is to be made by the company and its investors [you know who you are….and I’ll find out soon enough] in carbon offset credits [emission reduction credits]. The CA Attorney General, Brown, has called for a warning against companies trying to make money in this program by committing fraud by marketing their projects as renewable energy and or having the capabilities to be used as a facility to offset carbon. http://ag.ca.gov/newsalerts/release.php?id=1520

It is time for the Attorney General to take a look at this project because the facility is an incinerator and needs to be environmentally evaluated as such.

BIAS? I took the PMC Pacific Ethanol EIR apart, I found flaws in their scientific findings. Although the DATA showed significant impacts, the final CONCLUSION was that the project would NOT have any significant impact on the surrounding community- daycares and schools included. IVP chastised my analysis. Interestingly, now numerous prestigious universities including Stanford have completed evidence-based research showing just how harmful ethanol production really IS. CNN has even been reporting about it. Despite govt. subsidies, the ethanol industry is a bust because of its detrimental impact across several markets. High prices on corn mean higher prices for the beef industry as well as for human beings who use corn for everything; tortillas included. "

" 200 + - trucks a day congesting our traffic system and tearing up our old roads. And the emissions from these trucks polluting our air and our neighbors air during their route. This sludge should be dealt with in LA where it originates. Dont they need the electrical power, especialy with this so called green power requirement more than we do? We have an abundance of green power (geothermal) and proposed solar fields, lets develop those not dierty, ugly, disguting sludge. Incinerate it in your own backyard, a law should be passed. "

Have you checked if Liberty Energy described themselves as “Power Plant” for the EIR? They must be scrutinized as “Incinerator Plant” which in fact has more stringent environmental limits than a Power Plant permit.
